Shunfuchang Rubber denies Toyo's tire suit

Weifang Shunfuchang Rubber & Plastic Co. Ltd. denied today that they sold any infringing tires in U.S. and claimed that Shandong Hengyu Rubber Co.Ltd. stole their design patent number and tabbed on their infringing tires sold in U.S..

The company also told Tireworld’s journalist that they have no tire products sold in U.S. until now.

Not in surprise, Shandong Hengyu also denied Shunfuchang’s claim to Tireworld’s journalist.

Recently, the U.S. International Trade Commission ("ITC") has issued its final determination against eight remaining respondents in the tire design patent infringement complaint filed by Toyo on September 20, 2013.

The ITC issued limited exclusion orders and cease-and-desist orders to prohibit the importation and sale of any infringing tires by these eight respondents. Each was previously found to be in default and in violation of the law.

The referred Chinese tire companies include Hong Kong Tri-Ace Tire Co. Ltd., Weifang Shunfuchang Rubber & Plastic Co. Ltd., Doublestar Dong Feng Tyre Co. Ltd., Shandong Yongtai Chemical Group Co. Ltd., Shandong Linglong Tyre Co. Ltd.,.

South China Tire and Rubber Co. Ltd., Guangzhou South China Tire & Rubber Co. Ltd., involved in suit before have reached an agreement with Toyo earlier this year, and promised not to sell any infringing tires in U.S. anymore.
